Sales status

Status note: Everyfile Pro is not on sale yet. Sales start with version 1.0. Until then these terms are advance information only; nothing can be ordered yet.

1. Scope and seller

These terms apply to buying Everyfile Pro through this website. The seller is Alexander Gallwitz, Im Königsmoor 12, 28876 Oyten, Germany, email: hello@everyfile.app.

A consumer is anyone who enters into the contract for purposes that are mainly neither commercial nor related to their self-employed profession. Terms of the buyer that differ from these do not apply.

2. Product

Everyfile is a file search for macOS. The basic version is free. Everyfile Pro unlocks additional features and is sold as a digital licence. The licence covers all updates of version 1.x. The product page lists what Pro includes.

The licence lets you use Everyfile Pro on your own Macs. Passing on or reselling the licence key is not permitted.

3. Conclusion of contract

The presentation on the website is not yet a binding offer. By completing the order process you make an offer to buy. The contract is concluded when I send you the licence key by email or confirm the order. No customer account is required.

4. Price and payment

The price shown in the order process applies (currently planned: one-time 24 EUR). It is a single payment, not a subscription. Under § 19 UStG (German small-business rule) no VAT is charged or shown. More information is on the Pricing information page.

5. Delivery

Delivery is digital: you receive the licence key by email at the address you give, usually right after payment is received. You download the app itself from this website. The app checks the key offline.

6. Right of withdrawal

Consumers have a statutory right of withdrawal. Details are in the Withdrawal policy.

7. Usage rights

You receive a simple, non-transferable licence of unlimited duration to use Everyfile Pro in the version purchased and all updates of version 1.x. All rights in the software remain with me. Open-source components are subject to their own licences (see THIRD_PARTY.md in the source repository).

8. Defects

The statutory warranty rules apply unless agreed otherwise. For digital products, §§ 327 ff. of the German Civil Code (BGB) apply. If something is defective, write to me with a short description; I will help or provide a corrected version or a new key.

9. Liability

I am fully liable for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable damage typical for this kind of contract. Otherwise liability is excluded. Mandatory statutory rights remain unaffected.

Everyfile reads file names and metadata only and does not change or delete your files. Backing up your data remains your responsibility.

10. Data protection

How data is processed is described in the Privacy policy. For a purchase only the data needed for the order is processed (in particular your email address). There is no account.

11. Governing law, dispute resolution

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another EU country, the mandatory consumer protection rules of that country remain unaffected.

I am neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

12. Contract language and changes

The contract language is German; this English version is a translation, and the German text prevails in case of doubt. The contract text is not stored separately; you can print or save this page at any time. Changes to these terms apply to future orders only.
